Wyre Council wishes to seek opinion as to whether or not it should renew its existing Public Space Protection Order (PSPO) in relation to alcohol related anti-social behaviour.
The PSPO which was originally created as a Designated Public Place Order under the Criminal Justice and Police Act 2001, now has effect under the Anti-Social Behaviour, Crime & Policing Act 2014 and covers certain public spaces within the towns of Cleveleys, Fleetwood, Garstang and Poulton-le-Fylde.
The effect of the Order is that an individual can be prosecuted or given a fixed penalty notice of up to £100, if they fail to surrender alcohol when asked to do so by an authorised officer.
The Order does not make it illegal to carry alcohol or to drink in a public place as long as drinking is done responsibly. The Order is therefore only used when necessary to tackle alcohol related anti-social behaviour, and no offence is committed if individuals comply with a request to stop drinking and / or dispose of alcohol when asked to do so.
In accordance with the requirements of the Anti-Social Behaviour, Crime & Policing Act 2014, the Order must be reviewed every three years. The council is therefore seeking the views of the public as to whether or not the existing Order should be renewed for a further 3 years; should be varied in respects to the areas which it covers; or should be discontinued.
Consultation on the Order will close on Sunday 15th November 2026 at 11:59pm, with the feedback received informing the Councils’ decision on the future of the PSPO.
