TERMS AND CONDITIONS:


PRIZE DRAW OVERVIEW
  1. The England and Wales Cricket Board Limited (company number 03251364) whose registered office is at Lords Cricket Ground, St Johns Wood, London, NW8 8QZ (the “ECB”) is operating a Competition for individuals who have opted in to receive marketing communications from the ECB to be in with a chance of winning their likeness being included in a mural design on a feature wall at Park Avenue Cricket Ground in Bradford (the “Prize”).
  2. Individuals entering the Competition (the “Entrants”) are deemed to have accepted, and agreed to be bound by, these terms and conditions (the “Competition Terms and Conditions”) upon entry into the Competition.
ENTRY PROCESS
  1. The Competition will be open for entry between 10:00 on 07/06/2024 (the “Opening Date”) and 12:00 on 28/06/2024 (the “Closing Date”). All entries must be received during of this period. All entries received after the Closing Date and/or other than in accordance with the entry requirements set out below will not be considered.
  2. To enter the Competition, Entrants must submit their photos taken at either a past Northern Superchargers game or showing their support for the team prior to the Closing Date which has been emailed to them by the ECB (the “Submission”)
  3. Entry takes place automatically upon completion of the Submission. Entries to the Competition will not be accepted by any other means.
ELIGIBILITY
  1. The Competition is open to all individuals who have completed the Submission and who are residents within the United Kingdom. Employees of the ECB or any of the First Class County Cricket Clubs are not eligible to enter the Competition. All entrants must be 18 years or older or have permission from a legal guardian that is over the age of 18 years old.
  2. By entering the Competition, Entrants confirm that they are eligible to do so and eligible to claim any prize they may win.
  3. There is a limit of one entry to the Competition per person.
  4. The ECB reserves the right to disqualify any Entrant if it has reasonable grounds to believe that the Entrant has breached these Competition Terms and Conditions.
PRIZE
  1. There will be one winner of the Competition (the “Winner”) and the prize for the Winner is having their likeness featured in the mural at Park Avenue Cricket Ground, currently scheduled to be completed 13th/14th July 2024 and unveiled on 23th July 2024.
  2. The entries will be collated by 2C using a data capture form, and the top Entrants will be shortlisted into a final selection, where Hatch and the Northern Superchargers team will collaboratively select The Winner based on a subjective judgement on, or soon after, the Closing Date.
  3. The prize is non-exchangeable, non-transferable and no cash alternative is offered. The prize does not include anything not expressly set out in these Competition Terms and Conditions. The prize is subject to availability and the ECB reserves the right, in its sole discretion, to substitute the Winner’s prize for an alternative prize, if necessary.
  4. The prize is awarded at the ECB’s discretion and no prize will be awarded as a result of improper actions on or behalf of any Entrant.
CLAIMING THE PRIZE
  1. The selection of the Winner by subjective judgement on the date specified above will be final. No correspondence or discussion will be entered into regarding the outcome of the Competition.
  2. The ECB will contact the Winner as soon as reasonably practicable after selection, using the email address provided upon entry to the Competition.
  1. The ECB reserves the right, in its sole discretion, to use the likeness of the Winner as detailed in clause 2.
  1. The ECB does not accept any responsibility for the Winner in the event they change their mind on having their likeness used.
LIMITATION OF LIABILITY
  1. Neither the ECB nor any of its partners, affiliates, agents, employees, officers, directors or representatives will be liable (to the fullest extent permitted by law) for any direct, indirect or consequential loss or damage arising out of the organising or holding of the Competition or as a result of any Entrant’s participation in the Competition or as a result of winning, collecting, use or enjoyment of any prize, if the Competition does not run as planned or if any part of any Prize is unable to be delivered for any reason. Entrants’ statutory rights are not affected.
  2. If the Competition or any part of it is not capable of running or being completed as planned for any reason, including but not limited to reasons of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of ECB, ECB reserves the right to cancel, terminate, modify or suspend the Competition without liability.
  3. The ECB accepts no responsibility for Competition entries that are not successfully completed or submitted, regardless of cause, including (without limitation) due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure, of any kind.
ENTRANTS’ PERSONAL DATA
  1. Any personal data relating to any individual which is received by the ECB in relation to the Competition will be used in accordance with applicable UK data protection legislation and the ECB’s privacy policy which can be found at: https://www.ecb.co.uk/privacy.
  2. The ECB may be required to either publish or make available information that indicates that a valid award took place. To comply with this obligation the ECB will send the surname and county of Winners to anyone who emails feedback@ecb.co.uk or sends a letter addressed to the ECB using the address given above, (enclosing a self-addressed envelope) within one month after the Closing Date. If an Entrant objects to any or all of his/her surname and county being published or made available, please contact the ECB using the email address or postal address referred to in this clause. In such circumstances, the ECB must still provide the information to the Advertising Standards Authority on request.
  3. If an Entrant has any questions about these Competition Terms and Conditions, including any request to exercise their legal rights under data protection law, they should contact the ECB at privacy@ecb.co.uk.
GENERAL
  1. The ECB reserves the right to refuse entry to the Competition, to disqualify from the Competition or to refuse to award the Prize to anyone who it reasonably considers has breached these Competition Terms and Conditions or to anyone who, in the ECB’s sole opinion, has otherwise acted improperly or dishonestly.
  2. The decision of the ECB regarding any aspect of the Competition is final and binding (including as to the award of the Prize and no correspondence will be entered into regarding any such decision.
  3. If any provision of these Competition Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Competition Terms and Conditions, which shall remain in full force and effect.
  4. These Competition Terms and Conditions and any dispute or claim (including any non-contractual disputes or claims) arising out of or in connection with them will be governed by and construed in accordance with English law and all Entrants submit to the exclusive jurisdiction of the English courts in relation to any disputes or claims arising out of, or in connection with, these Competition Terms and Conditions or the Competition.
